Melissa Fortier, Registered Dietitian, is committed to protecting your privacy and personal health information. This Privacy Policy outlines how personal data is collected, used, stored, and disclosed when you use this website or engage in nutrition services. This policy complies with Ontario's Personal Health Information Protection Act (PHIPA), the Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), and the standards of the College of Dietitians of Ontario. All communications with Melissa Fortier, RD, including those made through this website, newsletters, and individual nutrition counselling, are covered by this privacy statement. You agree to the practices outlined here by using this website or sending in your information.

1. What Information I Collect

I may collect personal information in the following ways:

  • Website forms: when you subscribe to emails, contact me, or book a service

  • Booking platforms: when you use Practice Better to schedule appointments or complete forms

  • Tools for technology: like cookies that monitor website traffic or Google Analytics

Your name, email address, phone number, address, IP address, browser type, general health concerns (if provided voluntarily), and preferences for or opt-in status to email marketing are some examples of the data that may be gathered. The only personal data gathered is that which is necessary to deliver services, satisfy legal requirements, or carry out regulatory activities. Your awareness or approval is required before information is used for unrelated reasons.

2. How Your Information is Used

Your information may be used to:

  • Respond to your inquiries or requests

  • Provide and manage nutrition services

  • Send newsletters, updates, or promotions (with your consent)

  • Improve website experience through analytics and performance tools

I do not sell or share your information with third parties for advertising purposes.

3. Email Communications

If you subscribe to emails or download free resources, your name and email address will be collected to send newsletters, updates, offers, or educational materials. These communications comply with Canada’s Anti-Spam Legislation (CASL).

You will only receive marketing emails if you have given express consent (e.g., by opting in via a form or downloading a freebie). You can unsubscribe at any time by clicking the "Unsubscribe" link in any email or by contacting info@melissafortier-rd.com.

Email data is stored securely in ConvertKit, a professional email marketing platform. Your information is never sold or disclosed to third parties for marketing purposes.

Please note: messages sent through email or contact forms on this website are not fully secure. For clinical communication or sharing of personal health information, a secure platform (Practice Better) is used. By contacting me, you consent to receive replies via the method you initiated unless you request otherwise.

4. Use of Cookies

This website uses cookies and similar technologies to support essential site functions and to collect limited, non-identifiable data for analytics and marketing purposes.​

Types of cookies used:

  • Essential cookies: Required for secure access and site functionality (e.g., session cookies from Wix or Practice Better)

  • Analytics cookies: Track anonymous usage data via Google Analytics to improve performance and content

  • Marketing cookies: Used by tools like Facebook Pixel and ConvertKit to support newsletter sign-ups and measure campaign effectiveness

5. Clients Receiving Individual Counseling

When you receive one-on-one nutrition counseling, personal health information is collected, used, and disclosed only as necessary to provide safe, effective, and ethical care. This includes information you provide directly (e.g., during a discovery call), as well as information collected through assessments and follow-ups.

5.1. What is personal health information?

Personal information includes your name, contact details, date of birth, health history, care received, social or lifestyle factors relevant to care, and any goals or preferences discussed in sessions.

5.2. Why your information is collected:
  • To assess your needs and provide personalized nutrition services

  • To monitor progress over time and adjust your plan

  • To communicate about your care or appointments

  • To issue invoices, insurance receipts, or documentation as requested

  • To meet legal and regulatory obligations

5.3. Additional uses may include:
  • Quality assurance and professional consultation

  • Regulatory inspections by the College of Dietitians of Ontario

  • Reporting misconduct, risk to safety, or as required by law

  • Communication with insurance providers or third parties (with your consent or legal authority)

Your personal health information is never sold and is not shared for advertising or marketing purposes.

5.4. Consent

Consent for collection, use, or disclosure may be implied (e.g., coordinating care) or express (e.g., sharing with third parties). You may withdraw consent at any time by notifying Melissa Fortier, RD in writing via secure message or email. Withdrawal will not affect care already provided or information shared with prior consent.

5.5. Storage and retention

Client records are stored electronically and securely through Practice Better, a PHIPA- and PIPEDA-compliant platform. Records are retained for at least 10 years after your last session, or 10 years past the age of majority for minors, in accordance with the College of Dietitians of Ontario’s recordkeeping standards. When client records are no longer required, they are securely destroyed in accordance with the College of Dietitians of Ontario’s guidelines for record disposal.

5.6. Health Information Custodian

As a Registered Dietitian practicing in Ontario, I am considered a Health Information Custodian (HIC) under the Personal Health Information Protection Act (PHIPA), and follow all applicable standards outlined by the College of Dietitians of Ontario.

5.7. Terms of Service

For more information about working together, including payment, cancellation, and appointment policies, please refer to the Client Agreement & Terms of Service. You’ll be asked to review and agree to these terms before beginning services.

5.8. Your Rights as a Client

As a client receiving nutrition counseling, you have the right to:

  • Access or request a copy of your personal health records

  • Request corrections to inaccurate or incomplete information

  • Withdraw or restrict consent to the collection, use, or disclosure of your personal health information (unless otherwise required by law)

  • Request deletion of your records, where appropriate and permitted by law

  • Be informed about how your information is used and shared

  • File a complaint if you believe your privacy has been breached

To make any of the above requests, please contact info@melissafortier-rd.com. Identity verification may be required before processing your request. Most requests are addressed within 30 days. If corrections are made, any third parties who received the incorrect information will be notified as appropriate.

In the event of a privacy breach, I will follow the procedures set out under the Personal Health Information Protection Act (PHIPA), including notifying affected individuals and/or the Information and Privacy Commissioner of Ontario, as required by law.

6. How Your Information is Stored

All personal data—whether collected through counseling services, website forms, or newsletter sign-ups—is stored securely using professional platforms such as Practice Better, ConvertKit, Wix, SRFax, and Stripe (via Practice Better Payments). These platforms meet industry standards for encryption, access controls, and privacy compliance.

Safeguards include:

  • Encrypted platforms and password-protected access

  • Role-based access control (only authorized personnel can view personal information)

  • Physical security of electronic hardware and paper records

  • Confidentiality agreements with collaborators

Some third-party platforms may store data on servers located in the United States or other countries. While these services are selected for their strong privacy standards, information may be subject to the laws of the jurisdiction where it is stored

7. Your Rights

If you use this website but are not a client, you still have the right under PIPEDA to:

  • Know why your personal information is being collected and how it will be used

  • Access your personal data and request corrections

  • Withdraw your consent for data collection (e.g., cookies or marketing emails)

  • File a complaint if you believe your information is being misused

To make a request, contact info@melissafortier-rd.com. Reasonable steps will be taken to verify your identity before processing your request. For complaints, you may also contact the Office of the Privacy Commissioner of Canada at www.priv.gc.ca.

8. Third-Party Services

To deliver services securely and professionally, I use the following third-party platforms:

  • Practice Better—for scheduling, forms, secure messaging, and storage of client health records

  • Stripe (via Practice Better Payments)—for secure payment processing. Stripe is the underlying processor for Practice Better Payments and handles the collection, transmission, and secure storage of your payment details. Neither Practice Better nor Melissa Fortier, RD, stores full credit card data. See Stripe’s Privacy Policy.

  • ConvertKit—for email marketing and newsletter management

  • Google Analytics—for website performance monitoring (anonymous data only)

  • Wix—for secure website hosting and forms

  • SRFax—for secure electronic faxing of referrals and documents

  • Facebook Pixel—to assess advertising effectiveness

  • Google Maps—for embedded location purposes; may collect interaction data

All tools are selected based on their privacy and security standards. Please note that some third-party tools may store data on servers located outside of Canada, subject to the laws of those jurisdictions. 

9. Changes to This Policy

This Privacy Policy may be updated from time to time. The latest version will always appear on this page with an updated effective date. Clients will be notified if material changes are made that affect their rights or responsibilities, either by email or secure message through the Practice Better.
